Robert Durst has been charged with the murder of his first wife, Kathie McCormack Durst, who disappeared in 1982.

The second-degree murder charge against Durst, 78, comes nearly four decades after she disappeared. McCormack's body was never found, and she was legally declared dead in 2017.

Last week, Durst was sentenced to life in prison without parole for murdering best friend Susan Berman in 2000. Prosecutors in Los Angeles said Durst killed Berman, daughter of a Las Vegas mobster, because she "knew too much" about McCormack's disappearance.

The new criminal case against Durst was filed by a state police investigator, in Lewisboro, New York and is based on "conversations with numerous witnesses and observations of defendants, recorded interviews and observations of Durst's recorded interviews and court testimony in related proceedings", according to the Associated Press.

He was the subject of 2015's HBO crime documentary series The Jinx: The Life and Deaths of Robert Durst, which examines the mysterious life of the real estate icon and the key suspect in a series of unsolved crimes.

In the docuseries, Durst appeared to admit to killing people, and said he made up details about what happened the night Kathie disappeared because he was "hoping that would just make everything go away".

Last Saturday, Durst's lawyer, Dick DeGuerin, told The Los Angeles Times that his client has been admitted to hospital and placed on a ventilator after testing positive for COVID-19, just days after he was convicted for Berman's murder last week.

McCormack was 29 when she disappeared in January 1982 following an argument with her then-husband Durst, who had long claimed to authorities that he took her to a train station in order for her return to their Manhattan apartment.

While he initially claimed that the pair had spoken on her return, he later confessed that he had lied. Durst divorced McCormack in 1990 citing abandonment, according to the Associated Press.
