Swapan Dasgupta resigns as Rajya Sabha MP amid row over candidature for polls on BJP ticket
Nominated Rajya Sabha member Swapan Dasgupta on Tuesday tendered his resignation from the upper house of Parliament after being named as a BJP candidate in the West Bengal assembly elections.
Swapan Dasgupta tenders his resignation as a Rajya Sabha MP. His resignation has been sent to the Chairman of the House, it is yet to be accepted.

Dasgupta, who became a Rajya Sabha member in April, 2016, has been named by the saffron party as its candidate from Tarakeswar assembly seat in the poll-bound state.
Sources said that he has submitted his resignation, asking it to be considered effective from Wednesday.

Asked about his resignation, Dasgupta told PTI that 'I have always said whatever necessary steps will have to be taken will be done by me before I submit my nomination papers (for West Bengal polls).
His term as Rajya Sabha member was till April, 2022.
Trinamool Congress leader and Lok Sabha MP Mahua Moitra on Monday, 15 March, took to Twitter to say that nominated Rajya Sabha member Swapan Dasgupta must be disqualified for joining the Bharatiya Janata Party (BJP), under the 10th Schedule of the Constitution of India.
Swapan Dasgupta is BJP candidate for WB polls.
10th Schedule of Constitution says nominated RS member to be disqualified if he joins any political party AFTER expiry of 6 months from oath.
He was sworn in April 2016, remains unallied.

According to the Constitution, a member nominated to the House by the President is allowed to join a political party if he/she does so within the first six months of taking seat in the House.
“A nominated member of a House shall be disqualified for being a member of the House if he joins any political party after the expiry of six months from the date on which he takes his seat after complying with the requirements of Article 99 or, as the case may be, Article 188,” reads paragraph 2 (3) of the 10th Schedule of the Constitution.
