NEW YORK — Ice Spice is facing a new lawsuit over her hit song “In Ha Mood,” as New York City-based rapper D. Chamberz claims he recorded a similar song called “In That Mood” a year before Spice released hers.

Chamberz and his producer are now suing Ice Spice for copyright infringement, accusing her of hearing his original song on the radio and ripping it off, according to the lawsuit obtained by TMZ.

“In That Mood” was originally released on all major digital platforms in January 2022, and was also played on Hot 97 FM in NYC, claims Chamberz, who says social media receipts will serve as evidence.

The Coney Island, Brooklyn native, who boasts over 128,000 followers on Instagram, said he also performed his song over 20 times at NYC venues close to where Spice and her producer, Riot, are located.

Chamberz alleges that Spice’s song copies the beat, lyrics, hook, metrical placement, rhythmic structure and narrative context of his original version.

Spice’s “In Ha Mood,” is now certified gold and her music video for the single has garnered over 45 million views on YouTube. Chamberz is now requesting at least half of the song’s revenue, in addition to other damages.

Spice, who was born and raised in the Bronx, has risen to the top of the music industry in the past couple years with collaborations including “Princess Diana” (with Nicki Minaj), “Karma” (with Taylor Swift) and “Barbie World” (with Minaj and Aqua).

Last October, she performed “In Ha Mood” on “Saturday Night Live” and earlier this week was announced as part of Coachella’s 2024 lineup alongside Lana Del Ray, Doja Cat, Tyler, the Creator and dozens of other artists.
